الإطار الدستوري والقانوني للسلطة التنظيمية المحلية – دراسة مقارنة

تعد السلطة التنظيمية المحلية من بين المواضيع التي تستهوي أقلام الباحثين في السنوات الأخيرة، وذلك بالنظر إلى توجه العديد من الدول التي أجرت مجموعة من الإصلاحات على أنظمتها نحو إرساء مقومات اللامركزية وترسيخ الإدارة الترابية كشكل حديث من طرائق ممارسة السلطة. من خلال هذه التوطئة، حاولت الدراسة أن تبحث في جانبين مهمين من أسس تأطير السلطة التنظيمية المحلية، انطلاقًا من تحليل كيفية تناول الدساتير لهذا الموضوع، ومدى استحضاره في بنية القوانين المتعلقة بالإدارة الترابية/المحلية. كما حاولت الدراسة تقديم مجموعة من النماذج التي يمكن اعتبارها حالات خاصة، بحيث لا تُمارس فيها السلطة التنظيمية المحلية بالطرائق التقليدية المألوفة في الدساتير عادة. وداخل بنية المادة، سيتم تناول الموضوع من زاويتين مهمتين: الأولى تبين مختلف مظاهر احتواء الدساتير للسلطة التنظيمية المحلية، والثانية تبين مختلف صور تناول السلطة التنظيمية المحلية في القوانين الخاصة بالإدارة الترابية/المحلية.

Local regulatory authority is among the topics that have increasingly attracted the attention of researchers in recent years, given the trend in many countries that have implemented a series of reforms aimed at establishing the foundations of decentralization and solidifying territorial administration as a modern method of exercising power. This study, through its introduction, aims to examine two key aspects of the framework for local regulatory authority: first, an analysis of how constitutions address the issue, and the extent to which it is reflected in the structure of laws pertaining to territorial/local administration. The study also attempts to present a number of models that can be considered special cases, where local regulatory authority is not exercised in the traditional ways commonly found in constitutions. Within the structure of the paper, the subject will be discussed from two significant perspectives: the first examines the various manifestations of the inclusion of local regulatory authority in constitutions, and the second explores the different forms in which local regulatory authority is addressed in laws related to territorial/local administration.
