القانون العُرفي مِن مَنظور تَداوُلي

نسعى في هذا البحث إلى التعريف بالخطاب/ القانون العرفي (Discours coutumier) - بوصفه خطابا تداوليا بامتياز، الذي يُعد بمنزلة مصدر تشريعي رئيس لمختلف الأنماط اللغوية القانونية، ونقصد، تحديدا، الخطاب التشريعي والخطاب القضائي؛ إذ نجد الخطاب العرفي حاضرا بقوة في الخطابين معا، على الرغم من تباين بعض خصائصه؛ من قبيل: "الشّفاهية" (L’oralité)، والسّبق الزمني أو "الأقدمية" (L’ancienneté)؛ فهذا النمط الخطابي غير محدد من جانب الزمن، بالإضافة إلى اعتماده خَصيصة "الخيال" (L’imagination) بشكل كبير، عكْسَ بقية الخطابات القانونية... بيد أنه، على الرغم من التباين المذكور، إلا أنه خطاب يشترك مع غيره من الخطابات اللغوية القانونية الأخرى؛ من حيث كونُه "ملفوظا لغويا" (Énoncé linguistique)، و"خطابا توجيهيا" (Discours directif) بالدرجة الأولى، وخطابا يتبنى "الإيجاز اللّغوي" (La concision linguistique)، و"خطابا انتقائيا" (Discours sélectif)؛ أي إنه خطاب ينحو، في تشكيل خطابه وقواعده، منحًى انتقائيا؛ من خلال انتقاء مفرداته وعباراته... تجنُّبا للمصطلح الغامض والفضفاض والغريب، وعملية الانتقاء هذه -كما هو معلوم- ليست بالأمر السهل؛ فهي تنزل منزلة "الفن"؛ ومن ثم، فكلُّ من يستطيع انتقاء مفرداته، وإبداع مصطلحاته، وإنتاج خطابه (ولاسيما إذا كان هادفا)، فهو - بالضرورة - فنّان.

In this research, we seek to familiarize ourselves with customary discourse/law - as pragmatic discourse with distinction - which is a statutory source of key to various legal linguistic patterns, namely, legislative and judicial discourse; While customary discourse is strongly present in both discourses, although some of its characteristics, such as "oral", chronological or "seniority", vary, this rhetorical pattern is not time-bound, in addition to adopting a "fantasy" speciality in a large way unlike the rest of the legal discourse... Notwithstanding the divergence mentioned, however, it is a speech that shares with other legal language speeches, in that it is "linguistic", "orientation", "linguistic briefness" and "selective discourse", in the sense that it tends to build and shape its rhetoric and rules selectively through the selection of its vocabulary and phrases... In order to avoid the ambiguous, loose and bizarre term, this selection process - as is known - is not easy, it relegates the position of "art", and thus, everyone who can select its vocabulary, create its terminology and produce its speech (especially if it is meaningful) is - necessarily - an artist.
