الوقف على الحياة العلمية بالمغرب في العصر الوسيط من التصور إلى الأجرأة (النوازل الفقهية نموذجا)

نحاول في هذه المقالة معالجة مسألة الوقف التي عمل بها المغاربة لتنشيط الحياة العلمية في العصر الوسيط، وضمان استمرار العملية التعليمية في صفوف أبناء الفقراء الذين لم يكن بإمكانهم مواصلة تعليمهم بعد حفظهم للقرآن الكريم، واضطراراهم إلى التنقل خارج مدنهم، نحو مدينة فاس أو سبتة أو مراكش... لذا تدخل الفقهاء عبر ترغيب الناس في المساهمة في وقف الكتب والأراضي وغيرها من أجل ضمان استمرار التلاميذ في عملية التحصيل العلمي، والنهوض بالمجتمع. وسنركز في هذه الورقة على مسألة وقف الكتب، وكيف كانت تتم؟ وكيف يمكن الاستفادة منها؟ وما هي الشروط التي وضعها العلماء لضمان استمرار الوقف؟ ومتى تتغير وظيفته؟ وهل يمكن بيع هذه الكتب؟ وكيف كانت الدولة تحمي هذه الكتب المحبسة؟ هذه الأسئلة هي التي سنحاول مناقشتها في هذه الورقة.

In this article, we try to address the issue of endowment, which Moroccans worked on to stimulate scientific life in the Middle Ages, and to ensure the continuation of the educational process among the children of the poor who were unable to continue their education after memorizing the Holy Quran, and were forced to move outside their cities, to the city of Fez, Ceuta or Marrakesh... Therefore, the jurists intervened by encouraging people to contribute to endowing books, lands and other things in order to ensure the continuation of students in the process of scientific attainment, and the advancement of society. In this paper, we will focus on the issue of endowing books, how it was done? How can it be benefited from? What are the conditions set by scholars to ensure the continuation of the endowment? When does its function change? Can these books be sold? How did the state protect these endowed books? These are the questions that we will try to discuss in this paper.
