فقه التوقع في ضوء المقاصد الشرعية والدراسات المستقبلية

إن المتأمل في مصادر التلقي الشرعي وخاصة القرآن الكريم، يجد أن أصول فقه التوقعات مبثوثة بين ثناياه ومستمدة من تشريعاته،... فقد راعى القرآن الكريم عنصر المستقبل، وحثنا على العمل لهذا المستقبل والاستعداد له، كما حذرنا من التقاعس والتكاسل عنه، وشتان ما بين الفعل ورد الفعل، وبين من ينتظر ما يأتي به المستقبل، ومن يسارع نحوه مستخدما أدواته وآلياته، فهو في جوهره عبارة عن مجموعة من البحوث المتعلقة بالتطور المستقبلي للبشرية، والمستمدة من المقاصد الشرعية، والمستندة على أصول الفقه، والقواعد الفقهية، مما يسمح باستخلاص عناصر تنبؤية تساعد على افتراض مجموعة من النوازل المختلفة، الممكنة الحدوث، ومحاولة استشراف كل مآلات الأفعال المتوقعة في المستقبل كذلك، وإيجاد الأحكام الشرعية المناسبة لها. وإيمانا مني بأهمية هذا الموضوع في بعده المقاصدي، وقلة البحوث المؤلفة بخصوصه، ارتأيت تناوله بالدراسة والتحليل، وإثارة اهتمام الباحثين لهذا الموضوع الذي لم يعط حقه من الدراسة والتأليف، خصوصا وأن تطور العصر فرض على المهتمين صياغة رؤى تكاملية للدراسات المستقبلية، ستساعدهم على وضع أسس متينة ترتكز عليها هذه الدراسات لاستمثارها في كيفية الاستعداد للنوازل قبل وقوعها، عبر مجموعة من الأحكام والضوابط التي تحكم الاجتهاد. ولا يكتمل نجاح هذه الدراسات إلى بالاعتماد على فقه التوقع في مجالاته المختلفة كمصدر أصلي تبنى عليه دعائم هذه الدراسات، ولارتباط هذا الفقه بهذا النوع من الدراسات قسمت هذا البحث لقسمين تناولت في القسم الأول فقه التوقع من خلال تعريفه وبيان موقف العلماء منه، في حين خصصت القسم الثاني دور هذا الفقه في ضوء المقاصد الشرعية والدراسات المستقبلية. وقد خلصت هذه الدراسة إلى جملة من النتائج أهمها: أن استشراف المجتهد لمستقبل مجتمعه وقضاياه، والاجتهاد في استخراج الأحكام الشرعية واستنباطها لما هو آت من وقائع مستقبلية مفترضة متوقعة وممكنة الحدوث، أو مآلات متوقعة تخص المسلمين، هو أمر ضروري لقادة الرأي، وحتى ساسة الشعوب، وأصحاب المصالح والمختصين، وهذا يتطلب إشراك جميع العلوم والجهات لتأسيس قاعدة صلبة لهذه الدراسات ولبناء تصور كامل للنوازل التي يجتهد فيها في ضوء مراكزها.

Believing in the importance of this topic in its intentional dimension, and the lack of research authored on it, I decided to address it with study and analysis, and to arouse the interest of researchers for this topic, which was not given its right of study and authorship, especially since the development of the era imposed on those interested in formulating integrative visions for future studies, which will help them to lay solid foundations on which these studies are based to raise them in how to prepare for calamities before they occur, through a set of provisions and controls that govern ijtihad… This study has concluded a number of results, the most important of which are: that the mujtahid's foresight of the future of his society and its issues, and diligence in extracting legal rulings and deducing them for what is coming from the supposed future facts expected and possible, or expected outcomes for Muslims, is necessary for opinion leaders, even politicians, stakeholders and specialists, and this requires the involvement of all sciences and parties to establish a solid base for these studies and to build a complete perception of the calamities in which he strives in light of their centers.
